Malcolm MacKillop is a founding member of Shields O’Donnell MacKillop LLP (“SOM LLP”), a boutique labor and employment law firm based in Toronto, Canada. He has extensive litigation experience in federal and superior trial courts and courts of appeals, administrative and quasi-judicial tribunals, and arbitration processes.
Over the past 30 years, Malcolm has been a successful trial lawyer, professional speaker, professor of law, and author of several leading texts on employment law such as Employment Law Solutions, Creative Solutions, and Damage Control. He specializes in human rights and has built his legal career on two pillars: proactive legal advisement on all aspects of workplace law, and representation of employers and senior executives in all aspects of the employment law disputes.
Education and Early Career
Malcolm MacKillop began his career studying law at UNB Law School. He graduated in 1983 and articled in St John’s, Newfoundland. He was called to the Newfoundland and Labrador Bar in 1984. He became a regular columnist for the St John’s Evening Telegram on employment law issues and was the Founding President and Board member of the Mount Pearl Chamber of Commerce. Malcolm taught Business law in the Faculty of Commerce at Memorial University and Real Estate Law at the College of Trades and Technology.
In 1989, the same year Malcolm passed the Ontario Bar, he accepted a position in the employment and labor law department at a large Bay Street law firm. Having already proved his acumen in the field through cases such as Piercey v General Bakeries Ltd (1986), Malcolm continued to grow his career and impact workplaces throughout Canada. Additionally, he branched out his teaching experience to include the University of Toronto and the University of Western Ontario Law School.
Malcolm MacKillop was named amongst “the Top 500 Lawyers in Canada” (2008-2017) by Lexpert and was listed as a leading employment law practitioner in The Guide to Best Lawyers in Canada (2012). He was also given the BV rating in 2008 by Martindale-Hubbell. In 2016, he was awarded the Randall Echlin Mentorship Award.
Now, as a senior partner at Shields O’Donnell MacKillop LLP, Malcolm MacKillop maintains the highest standards of practice in employment and labor law. He is a member of both the Newfoundland and Labrador Bar and the Ontario Bar (1989). He is also certified by the Law Society of Upper Canada as a specialist in civil litigation.
Malcolm balances his career at SOM LLP with his work on his own not-for-profit organization, Lawyers International Food Enterprise (“LIFE”).
